Are THC Drinks Legal in Delaware?

Yes. THC drinks are federally legal hemp products under the 2018 Farm Bill, which defines hemp as cannabis containing no more than 0.3% delta-9 THC by dry weight, and every can of Hempzer meets that standard.

Hemp-derived THC drinks are also legal and regulated under Delaware state law for adults 21 and over. They’re a separate category from the state’s adult-use marijuana program, so you don’t need a card. You’ll find them in-person at stores holding a state permit, licensed marijuana retailers, and certain approved microbreweries. 

Drinks can only contain delta-9 THC extracted from hemp, with no alcohol, and are capped at 10mg per single-serving container and 60mg per multipack.

There’s a deadline to know about. A change to the federal hemp definition is scheduled to take effect on December 11, 2026, and Delaware’s beverage law is written to expire at the same time. Until then, our drinks remain legal under the 2018 Farm Bill, and Congress could still delay or change the new rules.
